The petitioner apprehends his arrest in connection with Banka P. S. Case No. 238 of 2017 instituted under Sections 420, 467, 468, 471 and 472 of the Indian Penal Code. The allegation, in brief, is that the petitioner, by using cheque of Bihar Rajya Anusuchit Jati Sahkarita Vikas Nigam Limited, withdrawn Rs. 3,41,000/- on 11.04.2017 and subsequently by other accused Rahul Kumar Maholi, Rs. 95,000/- has been withdrawn on 21.03.2017 though there is no provision of issuing cheque in the name of any other person and the amount is transferred to the beneficiary account only.

It is submitted that petitioner was a Sweeper on daily wages and it was the informant-District Executive Officer of the

Patna High Court Cr.Misc. No.30683 of 2017 (2) dt.10-07-2017 2/2 Bank, who had asked the petitioner to withdraw the amount by issuing cheque in his name in order to make him permanent and later on after being realized the intention of the informant that he is being used, he has filed complaint case against him. Considering the nature of allegation, the prayer for anticipatory bail of the petitioner is rejected. (Arun Kumar, J) Sujit/- U
