The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Hajipur Sadar P.S. Case no. 598 of 2020 instituted for the offence under Sections 341/323/307/379/34 of the Indian Penal Code and Section 27 of Arms Act.
As per allegation in the FIR, while the informant was at his door, co-accused Ankit Kumar called him and when both reached nearby Batera tree, petitioner and co-accused Munna Rai were ambushed there. Petitioner snatched the gold chain from the neck of the informant and co-accused Avinesh Kumar fired upon him which hit his stomach and he fell down and all accused persons including the petitioner fled away from there by a motorcycle. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case dur to dirty village
Patna High Court CR. MISC. No.56781 of 2021(3) dt.25-07-2022 2/2 politics. He has got no criminal antecedent. Allegation against the petitioner is of snatching chain from the neck of the informant. Specific allegation of firing is against co-accused Avinesh Kumar, which is supported by the injury report in which doctor has disclosed the nature of injury is grievous and probably due to gunshot. Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Hajipur Sadar P.S. Case no. 598 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned court of C.J.M. Vaishali at Hajipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
