This is a petition for grant of anticipatory bail for offence under Sections 25(1-b)a, 26 and 35 of the Arms Act. Six persons were traveling in a Tavera vehicle, four were apprehended and two fled away. Out of one of the apprehended persons, fire arm was recovered and the apprehended person disclosed name of the petitioner, who had fled away from there.

Considering the fact that there is no substantial material against the petitioner to substantiate allegation under the Arms Act, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Durgawati P.S. Case No. 147 of 2016 to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
