13-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Bihiya P.S. Case No. 20/2017 registered under Sections 147, 148, 149, 341, 307, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is though named in the First Information Report, however, no specific allegation of committing any overt act is there against this petitioner. It further appears that the case has been registered when the police party while on patrolling duty noticed that two groups of persons were involved in fighting in which one Arjun Ram son of Sarju Ram has sustained fire-arm injury.

No.31829 of 2017 (2) dt.13-07-2017 Learned counsel further submits that so far as the present petitioner is concerned, there is no allegation of firing against him, the co-accused Ajit Yadav, under similarly situated circumstance, has been granted privilege of Anticipatory Bail in Cr. Misc. No. 28082/2017, however, as submitted, petitioner has no criminal antecedent. Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara, in connection with Bihiya P.S. Case No. 20/2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
