The petitioner apprehends his arrest in connection with Dhanaha P.S. Case No.78 of 2022 instituted under Sections 147, 148, 149, 341, 323, 326, 307 and 379 of the Indian Penal Code. As per the prosecution story, the informant has alleged that the accused persons assembled and assaulted the informant's side. So far as this petitioner is concerned, allegation is that he gave 'Dab' blow on the nose causing injury to the informant. Learned counsel for the petitioner submits that the petitioner and the informant's side are agnates and simple conversation boiled into this assault between both the sides and unfortunately some of them were injured on either side. It is further submitted by the learned counsel for the petitioner that irrespective of the outcome of the present case, he is ready to pay Rs.10,000/- towards the treatment of the nose of the

Patna High Court CR. MISC. No.46063 of 2022(2) dt.02-01-2023 2/2 lady informant. His last submission is that the petitioner do not have any criminal antecedent.

Taking into account the aforesaid fact that he do not have criminal antecedent, there is case and counter case from both the sides, some of the co-accused have been released on bail as submitted by the learned counsel for the petitioner, he is ready to pay Rs.10,000/- towards the treatment of the lady informant, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Dhanaha P.S. Case No.78 of 2022 to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
