2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the 'Code') for the following relief: "That this is an application on behalf of the petitioner for quashing the order dated 23.7.14 passed by Sub-Divisional Magistrate, Patna, Sadar, in case no. 657/2014, notice issued in pursuance to the same on 23.07.2014."
3. At the very outset, learned counsel for the petitioner submitted that the present case was directed against the order by which notice was issued to the petitioner in a case under Section
Patna High Court CR. MISC. No.7307 of 2015(3) dt.15-04-2019 2/2 144 of the Code. He submitted that the validity of any order passed under this section is only for a period of 60 days which has elapsed much earlier as the order is of 23.07.2014. Accordingly, he fairly submitted that the matter has become infructuous.
