The petitioner seeks bail in connection with Mahila P.S. Case No. 11 of 2021 instituted for the offences under Sections 170 and 353 of the Indian Penal Code read with Sections 5, 26 and 29 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.03.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and is a women.

Learned counsel for the petitioner submits that the informant alleges that while she was interrogating the petitioner in Mahila Police Station with regard to her photograph with pistol in different poses, the petitioner became violent and

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and it is just not possible that a person who is being interrogated within the confines of the police station will act in a manner which will lead to her further implication. Learned counsel further submits that the allegation is only of creating hurdle during interrogation which prima-facie seems improbable.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 13.03.2021, is a person with clean antecedent, chargesheet has been submitted in the case and is a women, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of Smt. Preeti Kumari, learned Judicial Magistrate, 1st Class, Gaya in connection with Mahila P.S. Case No. 11 of 2021. (Satyavrat Verma, J) Rishi/- U T
