2. After some arguments, learned counsel for the petitioner submitted that the writ petition be disposed off with liberty to him to challenge the order denying counting of his service for the period 29.03.1957 to 01.09.1967 before the appropriate forum.

3. Learned counsel for the State does not object.

4. In view thereof, the writ petition stands disposed off as withdrawn with liberty aforesaid.

5. If the petitioner moves before the appropriate forum with regard to the said grievance, within one month from

Patna High Court CWJC No.19738 of 2012 dt.16-08-2017 2/2 today, the same shall be considered on merits, in accordance with law, without being prejudiced by the present order. It goes without saying that it shall be open to the petitioner to raise all points available to him before the said forum.
