The petitioner seeks bail in Dumra P.S. Case No. 131 of 2021, registered for the offence punishable punishable under Section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

91 litres of illicit liquor has been recovered from two tempo.

It is submitted that no recovery has been made from conscious possession of this petitioner. Name of this petitioner has surfaced in this case on the basis of confessional statement of co-accused. Petitioner has got no concern with the seized liquor. Petitioner is in custody since 30.06.2021 having no criminal antecedent, as stated in para 3 of the petition.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned IInd Additional Sessions Judge-cum-Special Judge (Excise), Sitamarhi in connection with Dumra P.S.
