The petitioner apprehends his arrest in connection with Naya Goan P.S. Case No.67 of 2022, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there was love affair between the victim girl and the petitioner, which is clear from Annexure-3 of the bail application.

Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.46096 of 2022(2) dt.05-12-2022 2/2 anticipatory bail of the petitioner by submitting that the victim girl has supported the prosecution case in her statement recorded under Section 164 Cr.P.C.

Taking into consideration the fact that the victim girl has supported the prosecution case in her statement recorded under Section 164 Cr.P.C., I am not inclined to enlarge the petitioner on anticipatory bail.
