Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioner is apprehending his arrest in Hathua P.S. Case No. 179 of 2019 registered under Section 366(A)/34 of the Indian Penal Code.
Prosecution case in short is that the accused persons including the petitioner abducted the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. An
Patna High Court CR. MISC. No.56404 of 2021(2) dt.31-03-2022 2/2 affidavit (Annexure-2 to this petition) has been filed by the victim wherein she has stated that she solemnized marriage with the co-accused namely Bigu Singh out of her love and affection. The petitioner has been made accused only because he happens to be close associate of co-accused Bigu Singh. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S.
