JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of her arrest in connection with Hajipur Sadar P.S. Case No. 363 of 2019 registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code. Prosecution case, in short, is that informant made an agreement with the petitioner and her husband for sale of a piece of land on Rs.10 lacs and informant has paid Rs.1 lac through R.T.G.S. to the account of husband of the petitioner and again transferred Rs.3 lacs from the account of his mother to the account of husband of the petitioner and further petitioner has received Rs.2.6 lacs in instalment from the informant, altogether he has paid Rs.6,60,000/- but the petitioner has not executed sale deed nor returned the amount.
Patna High Court CR. MISC. No.43841 of 2019(2) dt.17-07-2019 2/2 Submission of learned counsel for the petitioner is that FIR itself disclosed that agreement was between the informant and husband of the petitioner and amount was transferred to the account of husband of the petitioner through R.T.G.S. and she has falsely been implicated in this case just to put pressure on her husband.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 363 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
