JUSTICE BIRENDRA KUMAR ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Puraini P.S. Case No.58 of 2018, registered for the offences punishable under Sections 341/323/307/34 of the Indian Penal Code.

The petitioner allegedly caused fire-arm injury at the hand of the informant. The doctor has found consistent injury. Submission of the learned counsel for the petitioner is that son of the informant was accused in the kidnapping and murder of the son of the petitioner. Therefore, the present false case has been lodged. The FIR would reveal that besides the petitioner, co-accused Sanjeev Yadav also fired at the informant

Patna High Court Cr.Misc. No.49688 of 2018 (3) dt.31-10-2018 P2/ causing injury at the chest.

Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused.
