Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. Prosecution case, in brief is that the informant is partner in Baijnath Construction Pvt. Ltd. On 19.20.10.2019 in the night his driver parked his Highwa Truck in from of his house, at road and after getting information he woke up in early morning and found that his truck is not there and after a lot of search he did not succeed to trace his truck. Patna High Court CR. MISC. No.3764 of 2021(2) dt.25-03-2021 2/2 petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner is not named in the FIR. On the confessional statement of co-accused namely Ashok Kr. Jaishwal and Awadesh Kishore Rai, the petitioner has been made accused in this case and the said co-accused have been granted regular bail by the Co-ordinate Benches of this court vide order dated 03.02.2020 passed in Cr. Misc. No.6282/2020 and vide order dated 05.02.2020 passed in Cr. Misc. No.7745/2020. The petitioner is languishing in judicial custody since 14.07.2020.

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Daudnagar P.S.
