The petitioner is apprehending his arrest in connection with Budha Colony P.S. Case No. 33/17 for the offences punishable under Sections 420, 379 of the Indian Penal Code. Petitioner was domestic help of the informant. The allegation is that the old mother of the informant had kept some signed cheques which the petitioner removed and encashed through RTGS. The petitioner got transferred some of the money in his own account.
Submission of the learned counsel for the petitioner is that the case diary whether reveal that there is no material to show
Patna High Court Cr.Misc. No.22077 of 2017 (3) dt.04-07-2017 2/2 as to who had encashed those stolen cheques nor there is scope that any other person can get money transferred through RTGS. Due to dispute relating to non-payment of wages false case has been lodged.
Let, the petitioner, above named, in the event of his arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Budha Colony P.S Case No. 33/17 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
