The petitioner seeks bail in connection with Ghorashan P. S. Case No.16 of 2019, instituted for the offences under Sections 363, 366A and 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2020, charge-sheet has been submitted in the case and has antecedent of one case. The learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the same appears improbable for the reason that no wife in connivance with her own husband would kidnap a minor for getting her husband married.

No.55776 of 2021(2) dt.22-02-2022 2/2 The learned counsel for the petitioner submits that the victim was recovered from Motihari Bus Stand and she appeared before the police on her own. The learned counsel further submits that co-accused Din Bandhu Thakur and Sandhya Kumari @ Sundri Kumari have been granted bail by order dated 17.10.2019 in Cr. Misc. No.63300 of 2019. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and co-accused have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-3, Sikrahana at Dhaka, East Champaran in connection with Ghorashan P. S. Case No.16 of 2019.

The application stands allowed.
