The petitioner apprehends his arrest in Complaint Case No. 1593 (C) of 2015 registered for the offence punishable under Section 498(A) of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.

The complainant alleged that she was married to the petitioner on 21.05.2011 but thereafter the petitioner stopped her providing food and clothes. The petitioner and other family members demanded additional dowry and due to non-fulfillment of demand of dowry the complainant was driven out from the house.

Patna High Court Cr.Misc. No.16158 of 2017 (3) dt.04-07-2017 2/2 Learned counsel for the petitioner submits that the petitioner is ready to keep his wife on any undertaking but the wife of the petitioner is not ready to live with the petitioner because the petitioner has got step mother and step brothers. Learned counsel for the informant submits that the complainant is not ready to live with her husband and she may get some maintenance.

Considering the facts aforesaid and the fact that the complainant is not ready to live with her husband and she is interested in getting maintenance rather than living with her husband, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Sub-Divisional Judicial Magistrate, Patna in Complaint Case No. 1593 (C) of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
