JUSTICE SATYAVRAT VERMA ORAL ORDER 24-03-2022 The learned counsel for the petitioner today has filed a supplementary affidavit bringing on record the order dated 09.03.2022 passed by the learned Court below, is kept on the record.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 20 and 22 of the N.D.P.S. Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 14.06.2021, charge-sheet has been submitted in this case and has antecedent of one case. Allegation is of recovery of one loaded country-made

Patna High Court CR. MISC. No.58292 of 2021(3) dt.24-03-2022 2/2 pistol along with a mobile and as far as recovery of charas is concerned i.e. from co-accused Raju Kumar and Niraj Kumar. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the case and the thrust of the allegation against him is under the Arms Act and the petitioner has remained in custody for nearly 09 months. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and no narcotics were recovered from his possession, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mushahari P. S. Case No.102 of 2021.

The application stands allowed.
