JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2025 The present petition has been filed for restoration of a petition bearing CWJC No. 13232 of 2023, which has stood dismissed for default on account of non-removal of the defects within the peremptory time granted to the petitioner to do so vide order dated 22.01.2024 passed by this Court. 2.

The learned counsel for the petitioner has submitted that now all the defects have been removed, hence a sympathetic view be taken and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid petition bearing CWJC No. 13232 of 2023 to its original file, subject to the registry verifying as to whether all the defects pointed out by the registry have been removed or not.

Accordingly, the present petition stands disposed off on the aforesaid terms.
