1. Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State.
2. The petitioners apprehend their arrest in connection with Amas Police Station Case No. 118 of 2023, dated 31.03.2023, registered for the offences punishable under Sections 147/149/341/323/307/353/504/506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that this is
Patna High Court CR. MISC. No.51759 of 2024(2) dt.09-08-2024 2/3 second attempt by the petitioners for grant of anticipatory bail inasmuch as by order, dated 10.01.2024, passed in Cr. Misc. No. 78637 of 2023, whereby the prayer for anticipatory bail of the petitioners have been allowed and they were directed to surrender before the learned Court below within a period of four weeks from the date of order and furnish bail bonds. Since the petitioners could not surrender within time and as such they filed a modification application, bearing Criminal Miss No. 27012 of 2024. which was dismissed on 17.05.2024, being devoid of any merit.
4. On the other hand, learned counsel appearing for informant submits that no fresh material and grounds have been placed by the petitioners to maintain this second anticipatory bail application.
5. After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that no fresh material or development has been brought on record by the petitioners in the present application, this second application for grant of anticipatory bail is not maintainable.
