JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2019 Earlier the prayer for bail of the petitioners was dismissed vide order dated 17.12.2018 passed in Cr. Misc. No. 73849 of 2018 and there was allegation the petitioners is of recovery of huge quantity of liquor.

Submission of learned counsel for the petitioners is that earlier while dismissing the prayer for grant of regular bail to the petitioners, they were given the liberty that if the trial is not concluded within a period of five months, they may renew their prayer for bail and the aforesaid period of five months have already expired and there is no likelihood of conclusion of trial and they have been in custody since 14.09.2018.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Excise (Sherghati) Case No. 345/2018, subject to the condition that one of the bailors of the petitioners will be local person having sufficient immovable property within the jurisdiction of the concerned court below and further petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds .

The court below is directed to verify the address of the petitioners as well as that of the bailors before releasing the petitioners on bail.
