The petitioner seeks bail in Kankarbagh P.S. Case No. 503 of 2019, instituted for the offence under Section(s) 341, 323, 279, 384, 386, 504/34 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act. Counsel for the petitioner submits that petitioner has no criminal antecedent.

It is alleged in the written report that on the date of occurrence the informant who is driver of Truck bearing Registration No. UP79T-5682 reached Patna with truck. After unloading the truck he went to Hajipur. When he reached near Jaganpura More, one Honda City car dashed with the truck.

Patna High Court CR. MISC. No.43916 of 2019(2) dt.19-07-2019 2/2 The informant stopped the truck. Thereafter, 4-5 persons including petitioner got down from the Honda City Car and started beating him. They made demand of Rs.1,00,000/-as compensation.

Counsel for the petitioner submits that petitioner has been falsely implicated in the instant case at the behest of the driver by the Police. In fact, the car of the petitioner was damaged due to collision with the truck of the informant. Petitioner is in custody since 30.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna, in connection with Kankarbagh P.S. Case No. 503 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
