Petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of the IPC. As per F.I.R., on 25.05.2018, while the informant was doing her household works, she saw that this petitioner alongwith other co-accused were talking with each other. In the meantime, her husband arrived on a motorcycle and he was pushed down from the motorcycle and the co-accused, Manjit Singh and this petitioner caught hold of him and at the instigation of petitioner, co-accused Manoj Singh inflicted Tangi blow on the Neck of her husband and co-accused Devendra Singh assaulted on his leg by Dab as result of which, he became unconscious. It has further been alleged that after keeping the dead-body of the husband of the informant near the husk and woods, this petitioner poured kerosene oil on him and set him on fire.

No.56988 of 2021(3) dt.12-05-2022 2/2 It is submitted on behalf of petitioner that this petitioner alongwith his entire family members including female members have been made accused in this case due to land dispute between the parties. Petitioner is none else but nephew of the deceased. In fact, the deceased was a short-tempered person and he was aggressor and assaulted with fasuli on father of petitioner and when this petitioner came to rescue, then in scuffle, the deceased sustained injury and died. Petitioner is in custody since 30.05.2021.

However, learned A.P.P. for the State opposed the prayer for bail of petitioner and submitted that there is specific and direct allegation against this petitioner of assaulting the deceased and setting him on fire.

Considering the facts and circumstances, as stated aforesaid, as well as nature of accusation, the prayer for bail of petitioner is rejected.
