JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Nawada (Kadirganj O.P.) P.S. Case No. 856 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 11.05.2021, charge-sheet has been submitted in this case and allegation is of recovery of 765.435 litres of liquor from a room of one, Shailendra Kumar Yadav. Learned counsel for the petitioner submits that the name of this petitioner transpired in the confessional statement of Shailendra Yadav, with whom the petitioner has no concern,

Considering the fact that petitioner is in custody since 11.05.2021, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Nawada, in connection with Nawada (Kadirganj O.P.) P.S. Case No. 856 of 2020.

The application stands allowed.
