JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 04.06.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 341, 379, 380, 448 of the I.P.C.

It is alleged that Baleshwar Yadav and Kapileshwer Yadav wrapped towel in the neck of the informant and dragged when other co-accused persons assaulted the informant and took away motorcycle, cloth and cash of Rs. 35000/- of the informant.

It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the accused persons.

It is submitted by learned A.P.P that one of the injuries of the informant has been found to be grievous. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.40317 of 2014 (3) dt.16-01-2015 2/2 petition that petitioner has no criminal antecedent. Considering the nature of accusation, period under custody and the fact that petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 17 of 2014, G.R. No. 415 of 2014.
