2. This application has been filed to direct the

Patna High Court CWJC No.10151 of 2023(2) dt.28-11-2023 2/2 respondent authorities to remove the encroachment done by the private respondent no. 5 to 15 by filling public (Govt.) pond and construct their respective houses situated under Khata No. 384, Kheshra No. 2250.

3. The Circle Officer, Cirle Goriakhothi, Dist-Siwan is directed to act upon the representation dated 07.02.2023 preferred by the petitioner.

4. If Circle Officer, Cirle Goriakhothi, Dist-Siwan finds encroachment, he will proceed in this case under Bihar Land Encroachment Act, 1956 and will pass necessary order in accordance with law after hearing the parties including the encroachers.

5. The encroachment proceeding must be disposed of within three months of receipt/communication of copy of this order.

6. With the aforesaid observation and direction, this application is disposed of.
