2. The petitioner seeks bail in connection with Sahebganj P.S. Case No. 25 of 2025 registered for the offence punishable under Sections 8(c) and 21 of the NDPS Act.

3. As per the prosecution case, the recovery is of 28 gm. of smack from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is not accused in any other case though he is accused in one Dehradun Kotwali P.S. Case No. 520 of 2023. The petitioner is in custody since 19.01.2025.

5. Considering the quantum of recovery, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two

No.49232 of 2025(2) dt.11-08-2025 2/2 sureties of the like amount each to the satisfaction of the learned Special Judge, Exclusive Special Court-I (NDPS), Muzaffarpur in connection with Sahebganj P.S. Case No. 25 of 2025, subject to the condition that both the bailors should be the close relative of the petitioner.

7. The petitioner will also mark attendance in Sahebganj (Rajepur O.P.) Police Station, District- Muzaffapur on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.

8. At the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner from the S.S.P./S.P., Dehradun (Uttarakhand) apart from Dehradun Kotwali P.S. Case No. 520 of 2023. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.
