JUSTICE SUDHIR SINGH ORAL ORDER 03-01-2018 Learned counsel for the petitioners is permitted to make necessary corrections in para-1 of the writ application in course of day.
The petitioners in the present writ application have sought for direction upon the respondent no.4 to recommend the name of the petitioners for appointment on the post of Assistant Teacher in pursuance to the Advertisement No.210/2010 and further for a direction upon the respondents State particularly the respondents no.2 and 3 to appoint the petitioners forthwith on the post of Assistant Teacher on the basis of such recommendation as
Patna High Court CWJC No.15888 of 2012 (7) dt.03-01-2018 2/3 the petitioners belong to B.C. category and the candidates trained up to 2006 have been appointed by the authorities. In other words the persons having equal qualification, same session from the same institution, as well as, the persons junior to the petitioners have been inducted in service, ignoring the claim of the petitioners for their appointment on such post, which is contrary to Articles 14 and 16 of the Constitution of India and further for any other appropriate relief or reliefs for which the petitioners are entitled in the facts and circumstances of this case.
The Bihar Staff Selection Commission, Patna, the Respondent No.4 has already come out with a Notification No.3791/Aa. Dated 30.11.2017, whereby an objection has been raised by the applicants.
