1. Heard learned counsel for the petitioner and learned AAG-12 for the State.
2. The Circle Officer, Biharsharif, DistrictNalanda in compliance of the order dated 13.11.2024 is present in the Court.
3. The learned counsel for the petitioner submits that the instant writ application has been filed seeking quashing of the Memo No.5100 dated 01.07.2023 issued under the signature of the Circle Officer, Biharsharif,
Patna High Court CWJC No.11317 of 2023(4) dt.18-11-2024 2/3 District- Nalanda, whereby he has rejected the petition dated 21.06.2023 filed by the petitioner for correction of wrong entry in Register-II as Raiyati.
4. The Circle Officer, who is present in the Court at the outset, submits that he does not oppose the writ application.
5. The learned AAG-12 thus submits that the order impugned, in view of the submissions made by the Circle Officer, becomes vulnerable and thus, can be quashed. The learned AAG-12 next submits that if the petitioner files a fresh application seeking redressal of his grievance as raised in the instant writ application before the Circle Officer, the same shall be acted upon and the grievance of the petitioner shall stand redressed within a period of four weeks from the date of filing of the representation.
6. In view of the submissions made by the learned AAG-12, the order impugned contained in Memo No.5100 dated 01.07.2023 issued under the signature of the Circle Officer, Biharsharif, District- Naldana is hereby quashed.
7. The writ application is allowed.
8. The personal appearance of the Circle Officer,
