The petitioner apprehends his arrest in Bithan P.S. Case No.128 of 2017 registered under Sections 323, 353, 354 and other minor sections of the Indian Penal Code. The headmaster of Primary Middle School, Belachauri Panchayat, Pusho alleged that Mithilesh Ram, Vijay Ram (petitioner) and Dinesh Ram abused and assaulted the informant. The petitioner and one co-accused Mithilesh Ram were in drunken condition.

Learned counsel for the petitioner submits that no occurrence as alleged by the informant took place. No offence under Section 353 of the IPC is made out. The other offences are bailable. No specific allegation is made against the petitioner. The petitioner has got enmity with the informant and

Patna High Court CR. MISC. No.44232 of 2019(2) dt.18-07-2019 2/2 Bithan P.S. Case No.63 of 2010 is pending between the petitioner and the informant.

Having considered the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, Samastipur in connection with Bithan P.S. Case No.128 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
