2. The petitioner apprehends his arrest in connection with G.B. Nagar P.S. Case No.31 of 2024 instituted under Sections 323, 324, 307, 341, 504, 506 and 34 of the Indian Penal Code.
3. Allegation of abusing and assaulting the informant and her husband by means of fists and slaps is made against the accused persons including petitioner. The petitioner is also alleged to have teased the informant's daughter by catching her hair and on objection, threw her in fire when she came to rescue her mother (informant).
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive and land dispute. There is delay of
Patna High Court CR. MISC. No.49797 of 2024(2) dt.14-08-2024 2/2 four days in lodging the F.I.R. for the alleged occurrence. The petitioner and the informant are agnates. All injuries sustained by the injured are simple in nature. The petitioner has no criminal antecedent and he undertakes to cooperate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with G.B. Nagar P.S. Case No.31 of 2024, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) Harish/- U T
