JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Tariyani P.S. Case No. 79 of 2011, registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code. Allegedly, the petitioner being a P.D.S. dealer has misappropriated food grains amounting to Rs. 6,98,700/-. Submission is of false implication and that in this case similarly situated co-accused have already been allowed pre-arrest bail by another coordinate Bench of this Court. Satyendra Narayan Singh has been allowed pre-arrest bail vide Cr. Misc. No. 31460 of 2017 and others have already been allowed pre-arrest bail and the case of the petitioner stands on similar footing. The learned A.P.P. fairly submits that other co-

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sheohar in connection with Tariyani P.S.
