Mr. Binod Kumar for the State Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Town (Lohiya Nagar) P.S. Case No. 250 of 2021 instituted for the offences under Sections 452, 307 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel submits that the petitioner is in custody since 1.4.2021, charge-sheet has been submitted and has antecedent of one case and the allegation of firing on the informant is against co-accused Kundan Sada and as far as this petitioner is concerned he is alleged to have been present at the place of occurrence. The learned counsel submits that the

He had gone to the shop of the informant with Kundan Sada so that the issue between Kundan Sada and the informant could be mediated but Kundan Sada all of sudden fired at the informant causing injury on his waist and the petitioner came to be implicated.
Learned A.P.P. opposes the bail application. Considering the fact that the petitioner is in custody charge-sheet has been submitted and the allegation of firing is of Kundan Sada, let the petitioner above named be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Town (Lohiya Nagar) P.S.
