Mr. Bhanu Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-04-2022 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in a case registered for the offences under Section 392/34 of the Indian Penal Code. The learned counsel for the petitioners submit that the petitioners are in custody since 22.06.2021, charge-sheet has been submitted and has antecedent of ten cases and the informant alleges that he was intercepted by two unknown criminals who looted him of Rs. 50,895/- on the point of gun and snatched key of his motorcycle.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.55915 of 2021(3) dt.25-04-2022 2/3 the FIR was against unknown and the petitioners were arrested in Ghorasahan P.S. Case No. 160 of 2021 in which he was made to confess his participation in the present occurrence and thereafter he was remanded in the present case. The learned counsel submits that despite being custody since 22.06.2021, the petitioner was not put on T.I. Parade and nor any incriminating article was recovered from his possession, merely because of his antecedent, the police implicated him falsely in the present case. The learned A.P.P. vehemently opposes the bail application.

Considering the fact petitioners are in custody since 22.06.2021, charge-sheet has been submitted and the name transpired in his own confessional statement, the petitioners, above-named, are directed to be released on bail after framing of charge on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Adapur (Nakardei) P.S. Case No. 71 of 2021, with condition that one of the bailor shall be the respective fathers of the petitioners (Ram Ayodhaya Rai and Krishna Rai).

The Petitioners shall be released after framing of
