Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
This application has been filed on behalf of the petitioners for modification of the order dated 26-07-2021 passed in Cr. Misc. No. 3711 of 2021 by which, the petitioners were granted anticipatory bail in connection with Ishipur Barahat P.S. Case No. 47 of 2019.
At the outset, learned counsel for the petitioners submits that during pendency of this application, the petitioner
Patna High Court CR. MISC. No.52405 of 2022(2) dt.12-10-2022 2/3 Nos. 1 & 2 have already been taken into custody and hence, the application with regard to petitioner Nos. 1 & 2 has become infructuous.
Accordingly, this application with regard to petitioner Nos. 1 & 2 namely, Ranjan Ray @ Ranjan Kumar and Hareram Ray stands dismissed as infructuous.
Now this application is confined to the petitioner No. 3 only.
It is submitted on behalf of the petitioner No. 3 that he had gone outside the state for earning his livelihood and that is why, he could not surrender within the stipulated time. It is further prayed on behalf of the counsel for the petitioner No. 3 that further time may be extended so that the petitioner No. 3 could surrender in the court below.
Considering the submissions made on behalf of the learned counsel for the petitioner No. 3 and the grounds mentioned in the modification application, the order dated 2607-2021 passed in Cr. Misc. No. 3711 of 2021 is modified to the extent that the period of surrender of the petitioner No. 3 in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as
Patna High Court CR. MISC. No.52405 of 2022(2) dt.12-10-2022 3/3 mentioned in the order dated 26-07-2021 passed in Cr. Misc. No. 3711 of 2021.
Accordingly, this modification application stands disposed of.
