Petitioners seek bail in Barhara P.S. Case No.30 of 2019 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code.

Counsel for the petitioners submits that there is no allegation of specific overt act against the petitioners. In the written report, it is alleged that the petitioners and other accused armed with weapon came into the Angan of the informant and started assaulting the informant on account of land dispute. Husband of the informant made protest on account of which he was also assaulted with lathi by the accused persons and caused fracture injury in his leg and hand. It is further

Patna High Court CR. MISC. No.43162 of 2019(2) dt.18-07-2019 2/2 alleged that accused persons dragged the informant by catching hold their hair from Angan to Darwaja and brutally assaulted. Petitioners are in custody since 07.05.2019.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Purnea, in connection with Barhara P.S.
