It is submitted by the learned counsel for the petitioner that in paragraph no.3 of the order, it has wrongly been recorded that the informant earlier filed Mithanpura P.S.Case No. 349 of 2014 registered under Sections 406, 420, 467, 468, 471 and 120B/34 of the IPC rather the said case was earlier registered at the instance of informant but it was ultimately transferred to Kazi Muhammadpur Police station on the ground of territorial jurisdiction whereupon it was registered as Kaji Muhammadpur P.S. Case No. 342 of 2015. The informant earlier filed Complaint Case No. 2093C of 2007 before the learned JM, Patna with similar accusation wherein process has been directed to be issued after

Patna High Court Cr.Misc. No.15497 of 2016 (3) dt.04-10-2016 2/2 cognizance being taken for the offences punishable under Sections 406 and 420 of the IPC and 138 of the N.I., Act. Hence paragraph no.3 of the order dated 29.07.2016 stands modified to the extent as indicated above.
