The present writ petition has been filed seeking the following relief(s):- "1(i) To issue an appropriate writ/order/direction, to the Respondents to vacate and remove the illegal possession / construction made on the 2 (Two) Acres (Approx.) of the land which is part of 8.28 Acres of land appertaining to C.S. Khata No.23, Kheshra No.182 & 183 of Mauza Saifganj,

Patna High Court CWJC No.5073 of 2015(5) dt.26-09-2024 2/2 District Katihar over which the Petitioner is having his right and title as held by the Hon'ble High Court at Patna in First Appeal No.270 of 1996."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to raise the issues, raised in the present petition, before the executing Court in Execution Case No.01 of 2015, pending before the learned Court of Sub-Judge-III, Katihar. Liberty so sought is granted.

3. The writ petition stands dismissed.
