The petitioners apprehend their arrest in Bangaon P.S. case No. 55 of 2016 under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that accused persons including the petitioners came to his field and assaulted the informant and others.

Sri Krishna Prasad Singh, the learned senior counsel for the petitioners, submits that there is a case and counter case. From the side of the petitioners many persons got injuries. It is submitted that Bishundeo Yadav @ Bisundeo Yadav has been

Patna High Court Cr.Misc. No.16448 of 2017 (3) dt.05-07-2017 2/2 granted regular bail by this court. Prayer for anticipatory bail of Ram Chandra Yadav and another was disposed of by this court with a direction to surrender in the court below and the court below shall consider the prayer for regular bail of the petitioners taking into consideration that similarly situated accused Bishundeo Yadav has been granted regular bail vide order dated 09.05.2017 passed in Cr. Misc. No. 14910 of 2017 and dispose of the bail petition, preferably, on the same day.

Considering the facts aforesaid, this petition is disposed of with a direction to the petitioners to surrender in the court below, i.e., learned A.C.J.M.-I, Saharsa in Bangaon P.S. case No. 55 of 2016, and the court below shall consider the prayer for regular bail of the petitioners taking into consideration that similarly situated accused Bishundeo Yadav has been granted regular bail by this court and dispose of the bail petition, preferably, on the same day.
