2. The petitioner seeks bail in a case registered for the offence punishable under Section-7 of the Essential Commodities Act.

3. It is alleged that the petitioner is a PDS dealer. In course of inquiry of his shop, a shortage of 1188 kg. of wheat and 6954 kgs of rice was found. Prior to the occurrence, the same illegality was found as a result of which, the licence of the petitioner had been cancelled.

4. It has been submitted on behalf of the petitioner that not a single consumer has made any kind of allegation against the petitioner. The petitioner is in custody since 21-04-

It has also been submitted that earlier also, similar allegation was levelled against the petitioner in the year, 2020 and on the basis of allegation, though his licence was cancelled but now, his licence was has been restored by Annexure-2 to this petition.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 29 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
