Petitioner seeks regular bail in connection with Sursand PS Case No. 198/2019 registered for the offence punishable under Section 420/34 of the IPC.

As per the First Information Report lodged by the Circle Officer, alleging therein that Bagsit Purcha, issued in favour of the petitioner and two others, is forged and fabricated. Learned counsel for the petitioner submits that the petitioner along with his father applied for Bagsit Purcha which was duly issued by the Circle Officer, Sursand. Circle Officer is the competent authority to issue the Bagsit Purcha. He further submits that the Purcha contains the signature of Circle Officer

Patna High Court CR. MISC. No.46919 of 2022(2) dt.09-12-2022 2/2 which has not been found to be forged and fabricated. The petitioner is in custody since 29.04.2022 and the charge-sheet has been submitted in the matter.

Having regard to the submissions made by the parties and taking into consideration the nature of allegation and the fact that the petitioner is in custody since 29.04.2022 and the charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, PINKU RAI @ PINKU RAY @ PINKU KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Pupri at Sitamarhi/successor court in connection with Sursand PS Case No. 198/2019. (Anil Kumar Sinha, J) perwez U
