Petitioner apprehends arrest in connection with Piro P.S. Case No. 241 of 2015 registered under Sections- 323, 341, 504, 506, 379/34 of the Indian Penal Code and section 3(i)(x) of the SC/ST Act.
Learned counsel for the petitioner submits that no occurrence ever took place as alleged and petitioner has been falsely implicated in this case due to previous enmity. Petitioner has no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused and there is allegation of assault against him. Injury report supports the allegations levelled in the first information report.
Patna High Court Cr.Misc. No.23812 of 2017 (6) dt.01-08-2017 Witnesses have also supported the prosecution case. Considering the nature of allegations levelled against this petitioner and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected.
