JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard Mr. Amresh Kumar Sinha, learned counsel for the petitioner and Mr. Md. Shakir Ahmad, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Govindpur PS Case No. 157/2022 registered for the offence punishable under Sections 363, 366(A)/34 of the IPC. As per First Information Report, the daughter of the informant was abducted by the accused persons named in the FIR.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and his name transpired on the basis of confessional statement of the coaccused. The abducted girl was recovered and in her statement recorded under Section 164 CrPC, she has not disclosed the name of the petitioner. Learned counsel further submits that

No.46917 of 2022(2) dt.09-12-2022 2/2 during course of investigation, the only material, which has come against the petitioner, is that he had allegedly provided the train ticket to Dinesh Yadav who took the victim girl to Jaipur. Petitioner has got no criminal antecedent and he is in custody since 29.05.2022.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is not named in the FIR, the victim girl, in her statement recorded under Section 164 CrPC, has not disclosed the name of the petitioner and the petitioner is in custody since 29.05.2022 having no criminal antecedent, I am inclined to grant regular bail to the petitioner Accordingly, let the petitioner, ANAND PANDAY @ ANAND KUMAR PANDEY be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of Sri Kriti Prasad, learned Judicial Magistrate, 1st Class, Nawada/successor court in connection with Govindpur PS Case No. 157/2022.
