This application for anticipatory bail arises out of Supaul Nadi P.S. Case No. 13 of 2018/G.R. No. 555 of 2018, disclosing offences under Sections 147, 148, 149, 323, 341, 379, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner nos. 2 to 6 have already been granted anticipatory bail by order dated 29.08.2018 and for the purpose of considering the case of petitioner no. 1, the case diary had been called for which is available.
Learned Additional Public Prosecutor, appearing on
Patna High Court Cr.Misc. No.47293 of 2018(3) dt.20-09-2018 2/2 behalf of the State, based on the case diary, could not point out any specific evidence collected in course of investigation to justify implication of the petitioner no. 1.
Considering the above submission, this application is allowed.
Let petitioner no. 1 above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Supaul/Incharge Successor Court in Supaul Nadi P.S. Case No. 13 of 2018/G.R. No. 555 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner no. 1 shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
