JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Complaint Case No. 289 of 2016 registered for the offence punishable under sections 354, 354A, 376, 324 and 511 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the present complaint petition has been lodged in retaliation of the case earlier lodged by the petitioner's side i.e. Sahebganj P.S. Case No. 43 of 2016 as the brother of the petitioner was badly assaulted by the complainant's husband and her father and when petitioner went to rescue he was also assaulted. During investigation, witnesses have supported the case of the
Patna High Court Cr.Misc. No.41718 of 2017(3) dt.04-10-2017 2/2 petitioner. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Complaint Case No. 289 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
