JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2015 All the above stated three petitions are taken en-bloc as the said petitions arise out of Jamalpur P.S.Case No. 54 of 2014 registered under sections 25(1)(A)/25(1-AA)/25(1-B)a/25(1B)c/25(10B)c/26(2)/35 of the Arms Act and accordingly, the
Patna High Court Cr.Misc. No.37756 of 2014 (3) dt.03-02-2015 2/2 above stated petitions are being disposed of by this common order. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It would appear from the first information report, that one Vijay Tanti and petitioner in Cr. Misc. No.38658 of 2014 were caught by the police and fire arms as well as cartridges were recovered from possession of co-accused Vijay Tanti who disclosed that petitioners in Cr. Misc. No. 37756 of 2014 and petitioner in Cr. Misc. No. 43432 of 2014 were engaged in manufacturing fire arms and accordingly, the houses of both the above stated petitioners were raided but except some tools nothing was recovered. The petitioners, except petitioner in Cr. Misc. No. 38658 of 2014, do not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as period of detention of the petitioners in jail custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Jamalpur P.S.Case No. 54 of 2014.
