Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

It is submitted by learned counsel for the petitioner that in the order dated 16.02.2022 passed in Cr. Misc. No.49617 of 2021, the name of petitioner has been wrongly mentioned as Sujit Singh in the cause title portion which should have been Sujit Singh @ Anchit Kumar. It is further submitted that inadvertently the name

Patna High Court CR. MISC. No.44268 of 2022(2) dt.21-09-2022 2/2 of petitioner was wrongly mentioned in the bail petition also. It is submitted that he has filed a fresh Vakalatnama to bring on record the correct name of petitioner, as such, the same be rectified in the order dated 16.02.2022 passed in Cr. Misc. No.49617 of 2021.

Considering the submissions made above, let the name of petitioner in the cause title portion of the order dated 16.02.2022 in Cr. Misc. No.49617 of 2021 be read as "Sujit Singh @ Anchit Kumar" in place of Sujit Singh.

Accordingly, the period of surrender is extended by six weeks, after depositing Rs. 2000/- in the Victim Compensation Fund from the date of receipt/production of a copy of this order in connection with Excise Case No.553 of 2020, pending in the court of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran.

The order dated is modified to the extent indicated above. Let this order be read along with the order dated 16.02.2022. Accordingly, this modification application stands disposed of.
