The petitioners seek anticipatory bail in a case instituted for the offences under Sections 447, 341, 323, 307, 325, 427, 379, 504 and 506/34 of the Indian Penal Code. An altercation has taken place in the vegetable field. Allegation has been made against petitioner no.1 that he has given a blow by butt of the pistol and petitioner no.2 has given a blow by iron rod. In the case diary altogether five injuries were mentioned.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today,
Patna High Court Cr.Misc. No.20005 of 2017 (4) dt.20-07-2017 let petitioner no.2, Bimlesh Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheriya Bariyarpur P.S. Case No.116 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
So far petitioner no.1, Sunil Kumar Khuswaha alias Sunil Khuswaha is concerned, this Court is not inclined to enlarge him on anticipatory bail. Accordingly his prayer for bail is rejected.
