Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with N.T.P.C. P.S. Case No.03 of 2023 dated 05.01.2023 registered for the offence/s punishable under Section/s 341, 323, 379, 307, 504 and 506 read with Section 34 of the Indian Penal Code.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent, against him there is general and omnibus allegation, though altogether five accused persons including this petitioner have been named in the FIR but any specific role of them has not been revealed and similarly situated some co-

No.46717 of 2023(3) dt.01-08-2023 2/2 accused persons have been granted anticipatory bail by the Court below itself on 29.05.2023 of which order copy has been filed as Annexure-2 and petitioner's case stands on better footing from them as he has been languishing in jail since 16.02.2023 and against him the investigation has been completed.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and taking into account the circumstances pointed out by petitioner's counsel which go in favour of the petitioner's prayer, this Court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with N.T.P.C. P.S. Case No.03 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
