Learned counsel for the petitioner undertakes to remove the defects within three weeks of normal functioning of the court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 414, 34 of the Indian Penal Code.
Prosecution case is that the informant ASI of Nokha P.S. alleged that Agrer P.S. in-charge has informed him that the petitioner, arrested in Agrer P.S. Case No. 12/2020, has
Patna High Court CR. MISC. No.581 of 2021(2) dt.23-02-2021 2/2 confessed that earlier he had sold a stolen motorcycle to coaccused Rahul Kumar upon which the house was raided and a passion motorcycle was recovered in the gali in ward No. 12 at Nokha in abandoned condition.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that charge sheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner. He further submits that petitioner is languishing in judicial custody since 30.06.2020. In the facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram in connection with Nokha P.S.
